Terms of Service

These Terms of Service apply to products, downloads, tools and other digital goods made available through Benny Tools at get.benny.tools.

Benny Tools is operated from Queensland, Australia.

I have tried to keep these terms simple. The basic deal is: you buy a tool, you can use it, you can build things with it, but you cannot simply redistribute or resell the tool itself.

1. Buying from Benny Tools

Products listed on Benny Tools are digital products. Depending on the product, this may include software, code, prompts, templates, design systems, documentation, workflows, agents, configuration files, digital assets or other downloadable or accessible material.

Purchases are processed by Polar, which acts as the merchant of record.

That means Polar handles things such as checkout, payment processing, applicable transaction taxes and payment administration.

When you purchase a product, Polar's buyer terms also apply to the transaction.

These Terms govern your licence to and use of the Benny Tools product itself.

2. Your licence

Unless a product page says otherwise, purchasing a product gives you a:

• non-exclusive;
• non-transferable; and
• ongoing

licence to use that product for your own personal or business purposes.

The customer may be an individual or a single organisation.

You can modify, configure and adapt the product for your own work.

You can use the product to help create work for yourself, your business or your clients.

Where a tool produces an output, you may generally use those outputs for personal or commercial purposes, subject to any third-party rights, licences or platform terms that may also apply.

You are buying the right to use the product, not ownership of the underlying intellectual property.

3. What you cannot do

Unless I have given you permission, you cannot:

• resell the product itself;
• redistribute the original product;
• publicly share paid download files or access links;
• upload the product to a repository, marketplace, file-sharing site or similar service for others to obtain;
• package the product, or a substantially equivalent copy, as your own competing product;
• remove copyright, attribution, licence or ownership notices;
• give other people access to a purchase in a way that effectively avoids them needing their own licence; or
• use the product for unlawful, fraudulent, abusive or deliberately harmful activity.

Using a tool to create your own work is fine.

Selling the tool itself as though you made it is not.

4. Fair use

I want the products to be useful, not surrounded by complicated licensing rules.

Fair use here means using what you purchased in a reasonable way for yourself, your work or your organisation without turning one purchase into unrestricted distribution.

Normal use includes things like:

• installing or storing reasonable backup copies;
• using a tool across your own devices;
• modifying a tool for your own workflow;
• using it as part of internal business processes;
• using it while providing work to clients;
• creating commercial work using the tool; and
• experimenting, learning and adapting it to suit your own needs.

Fair use does not include deliberately using one purchase to supply the underlying product to unrelated people, companies or customers who would otherwise need their own copy.

If you are doing something unusual and are unsure whether it is fair use, contact me. I would much rather have a conversation than write another 40 paragraphs of licence conditions.

5. AI, APIs and third-party services

Some products may work with or depend on third-party platforms, APIs, AI models, software, libraries or services.

Those services can change.

Models change. APIs change. Platforms change their rules. Dependencies get updated. Occasionally somebody decides to rename an endpoint for no apparent reason.

I cannot guarantee that a product which depends on a third-party service will continue to work indefinitely without modification.

You are also responsible for complying with the terms, licences, usage limits and fees of any third-party service you connect to a product.

Where AI systems are involved, outputs may be incomplete, inaccurate or unexpected. You should apply appropriate human review before relying on an output for important decisions.

6. Product descriptions

I try to describe products accurately and show what they actually do.

Products are supplied substantially as described at the time of purchase.

Screenshots, examples and demonstrations are illustrative. Results may vary depending on your setup, software versions, models, APIs, data, configuration and other factors outside my control.

7. Updates

Unless a product specifically includes an update plan or subscription, purchasing a product does not guarantee future features, updates, compatibility work or ongoing development.

If I improve something and make an update available to existing customers, great. But I do not want to pretend every small digital tool comes with a lifetime software-development contract.

Where the site says "Buy once, keep it forever", this means your licence to the version you purchased does not expire.

It does not guarantee that the original download infrastructure, third-party dependencies or every future version of the product will remain available forever.

It is sensible to keep your own copy of downloaded products.

8. Support

Unless support is specifically included with a product, purchases do not include consulting, implementation, customisation or ongoing technical support.

That said, if something is clearly broken or confusing, tell me.

Feedback is useful.

9. Refunds

The short version is:

Ask and you get one.

Digital products are awkward to return, and I am more interested in understanding why something did not work for you than keeping a sale you regret.

Refunds are subject to the separate Refund Policy.

Nothing in these Terms limits any rights you may have under the Australian Consumer Law or another law that cannot legally be excluded.

10. Intellectual property

Unless otherwise stated, Benny Tools and the intellectual property contained in its products remain owned by me or the relevant rights holder.

Third-party software, libraries, models, content or open-source components remain subject to their respective licences.

Purchasing a product does not transfer ownership of trademarks, branding, copyright, source material or other intellectual property except where explicitly stated.

11. Your responsibilities

You are responsible for:

• determining whether a product is suitable for your intended use;
• safely configuring and operating it;
• maintaining appropriate backups;
• protecting credentials and API keys;
• reviewing outputs where appropriate;
• complying with applicable laws; and
• ensuring that your use of third-party services complies with their terms.

Do not place secrets, private data, production credentials or sensitive information into a tool unless you understand how that tool and any connected services handle that information.

12. No professional advice

Products, examples, documentation and outputs from Benny Tools are provided as tools and informational resources.

They are not legal, financial, medical, accounting, security or other regulated professional advice unless explicitly stated otherwise.

13. Liability

Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, including rights available under the Australian Consumer Law.

To the extent permitted by law, Benny Tools is not responsible for losses caused by:

• misuse of a product;
• modifications made outside the supplied product;
• failure of third-party services;
• changes to APIs, models or external platforms;
• loss of credentials or data caused by your configuration;
• reliance on AI-generated or automated outputs without appropriate review; or
• circumstances outside reasonable control.

14. Suspension or termination

I may suspend access to a product or service where there is reasonable evidence of:

• fraud;
• unlawful use;
• deliberate security abuse;
• licence circumvention;
• large-scale unauthorised redistribution; or
• other serious breaches of these Terms.

I will try to deal with genuine mistakes reasonably.

Termination for misuse does not affect rights that cannot legally be excluded.

15. Changes to these Terms

These Terms may change occasionally as Benny Tools evolves.

The current version will be published on the website with its last-updated date.

Changes will apply going forward and will not retrospectively remove rights already acquired under a purchase.

16. Australian Consumer Law

Nothing in these Terms is intended to exclude, restrict or modify rights available under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, where those rights apply.

17. Governing law

These Terms are governed by the laws applicable in Queensland, Australia, subject to any mandatory laws that apply in the customer's jurisdiction.
